We inform you that the privacy and processing of your personal data and sensitive personal data are protected under our Privacy Notice.

This Privacy Notice explains how Boehringer Ingelheim Animal Health Mexico S.A. de C.V. (hereinafter BIAH) handles the processing of personal data that BIAH collects in questionnaires, consents granted via telephone, written, electronic, by filling in documents, websites, corporate social networks, controlled by BIAH that are linked to this Privacy Notice (collectively called "BIAH Sites”), as well as by any other means permitted by law. This Privacy Notice applies to personal data collected by BIAH, but does not apply to other third-party sites with possible links from the BIAH Sites. Your use of the BIAH Sites is subject to this Privacy Notice and the Internet Terms of Use.

We ask you to read this Privacy Notice before using the BIAH Sites or providing us with Personal Data.

WHAT IS “PERSONAL DATA” UNDER THIS PRIVACY NOTICE?

"Personal Data" means any information concerning an identified or identifiable natural person that is processed by BIAH.

The collection, use, disclosure or storage of personal data, by any means. The use covers any action of access, handling, use, transfer or disposal of Personal Data. 

WHO IS RESPONSIBLE FOR THE PROCESSING AND PROTECTION OF YOUR PERSONAL DATA?

BIAH, with registered office at Maíz 49, Barrio Xaltocan, Xochimilco, C.P.16090, Mexico City, is responsible for the processing of your Personal Data in accordance with the applicable law.

FOR WHAT PURPOSES DO WE COLLECT AND PROCESS YOUR PERSONAL DATA?

 Your Personal Data will be processed for one or more of the following purposes: (i) compliance with BIAH's internal policies and procedures, (ii) compliance with applicable legislation in force and requirements of the competent authority; (iii) generation of studies, statistics, metrics, programs, reports and projects; (iv) evaluating the quality of services; (v) sending of advertising and promotional material; (vi) sending information about products and commercial programs, and their updates; (vii) registration of users, customers and suppliers; (viii) receiving, documenting and monitoring complaints; (ix) registration of access and security; (x) compliance with pharmacovigilance provisions; (xi) compliance with obligations with customers and suppliers; (xii) to provide services and products; and (xiii) to inform you about changes or new products or services; (xiv) to allow you access to our facilities; (xv) to integrate databases in accordance with the other purposes described here (xvi) so that the information is transferred by BIAH to its parent, affiliates, related companies, and/or to third parties contracted by BIAH for any of the purposes herein provided, (xvii) for the advance of any process before a public authority or a private person or entity, in respect of which the information is relevant.

WHAT PERSONAL DATA DO WE COLLECT AND FROM WHERE?

For the purposes outlined in this Privacy Notice, we may collect your Personal Data in a variety of ways: when you provide it to us directly, when you visit any of the BIAH Sites or use our online services, and when we obtain information from other sources that are permitted by law.

Some examples of Personal Data that we will obtain will be one or more of the following: (i) name; (ii) address; (iv) date of birth; (v) official identification number; (vi) unique population registration key; (vii) federal taxpayer register; (ix) telephone and/or cell phone; (x) email; (xv) photo or image, among others.

WHAT IS “SENSITIVE PERSONAL DATA” UNDER THIS PRIVACY NOTICE?

We inform you that, in order to fulfill the purposes set out in this Privacy Notice, Sensitive Personal Data may be collected and processed, which are those that affect the most intimate sphere of its owner, or whose improper use may give rise to discrimination, or carries a serious risk for it. Particularly sensitive are those who may reveal such things as racial or ethnic origin, present and future state of health, genetic information, religious, philosophical and moral beliefs, trade union membership, political opinions or sexual preference.

We undertake that they will be treated under the strictest security measures that guarantee their confidentiality.

We require your express written consent for the processing of your Sensitive Personal Data. 

HOW CAN YOU LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA?

You may limit the use or disclosure of your Personal Data by requesting it through the procedure for requesting ARCO Rights, revoking consent or refusing to use Personal Data for secondary purposes that is later mentioned in this document. As soon as we receive your request, we will register you in the exclusion list for the use and disclosure of Personal Data corresponding to meet your request.

HOW CAN YOU ACCESS, RECTIFY, CANCEL OR OBJECT TO THE USE OF YOUR PERSONAL DATA?

You have the right to know what Personal Data we hold about you, what we use it for and the processing conditions we give them (Access). It is also your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification). You also have the right to have it removed from our records or databases at any time (Cancelation), as well as to object to the processing of your Personal Data for specific purposes (Opposition). These rights are known as ARCO rights.

Arco rights application procedure

The mechanism that has been implemented for the exercise of the ARCO rights is through the sending of a request addressed to the email address datospersonales.mex@boehringer-ingelheim.com or, personally at the address mentioned in this Privacy Notice. In your application by email or in person, you must meet all of the following requirements:

1. Provide the following information:

    a. Name and surname;
    b. Address or other means of communicating the response to your request. It could be your mail    
     electronic;     
    c. Contact telephone number;
    e. City and State;

2. Attach a copy of the official documents proving his identity (voter's card, passport) or, where appropriate, those proving the holder's legal representation in accordance with the relevant legislation.

3. Provide a clear and precise description of the Personal Data in respect of which you seek to exercise any of your ARCO rights, revocation of consent, or refusal to use the data for secondary purposes.

4. Provide any other element, information or document that you have and that facilitates the location of your Personal Data:

    a. Relationship you have had with BIAH;
    b. Area name or BIAH person who contacted you;
    c. The means by which BIAH contacted you; or
    d. Name of the product, service, event or program for which you were contacted.

The deadline to provide you with a response regarding the determination made with respect to your ARCO request is twenty (20) business days from the receipt of your duly completed request.

The aforementioned period may be extended once for an equal period, provided that the circumstances of the case so warrant.

HOW CAN YOU REVOKE YOUR CONSENT TO THE USE OF YOUR PERSONAL DATA?

You may revoke the consent you have given us for the processing of your Personal Data. However, it is important that you bear in mind that not in all cases will we be able to respond to your request or terminate the Processing immediately, as it is possible that for some legal obligation we require to continue Processing your Personal Data. You must also consider that, for certain purposes, the revocation of your consent will mean that we cannot continue to provide the service you requested, or the termination of your relationship with us.
To revoke your consent you must submit your request through the ARCO rights application procedure.

CAN YOUR DATA BE TRANSFERRED OR SHARED WITH OTHERS?

Your Personal Data may be transferred and processed within and outside the United Mexican States by persons other than BIAH. In this regard, your information may be shared with other BIAH companies, its parent, affiliates, related companies, suppliers, authorities, distributors, collaborators, business partners, or agents to carry out the treatments authorized by law and to carry out the purposes contemplated in this Privacy Notice.

We undertake not to transfer your personal information to third parties other than those indicated above, without your consent, except for the exceptions provided in the applicable Law, as well as to make this transfer in the terms set by the Law.

Except in the cases eventually mentioned in the applicable law, if you do not express your opposition to the transfer of your personal data, you will be deemed to have given your consent to do so.

For the transfer of Sensitive Personal Data, we require your express written consent. 

HOW DO WE USE TRACKING TECHNOLOGIES IN OUR DIGITAL MEDIA?

We inform you that BIAH Sites use cookies or other technologies, through which it is possible to monitor your behavior as an internet user, as well as provide you with a better service and experience when browsing the BI Sites:

Cookies are text files that are automatically downloaded and stored on the hard disk of the user's computer when browsing a specific Internet page, which allow the Internet server to remember some data about this user.

The information we collect through this type of technology will be used for the following purposes: generation of studies, statistics, metrics, programs, reports and projects.

The information we obtain from these tracking technologies is as follows: identifiers, user name and password of a session, preferred language of the user, region in which it is located, type of browser, type of user operating system, client or application that it uses for the reception of email, date and time of the start and end of the session of a user, web pages visited by a user, searches made by a user, number of times that it displays a digital media, IP address.

WHO WILL HAVE ACCESS TO MY PERSONAL DATA?

A limited number of BIAH employees, its parent company, its affiliates, subsidiaries and/or related companies, and/or third parties contracted by BIAH, may access your Personal Data. For these purposes, we train our employees on the importance of privacy and on how to treat Personal Data appropriately and safely. In addition, it is BIAH's practice to require its suppliers or contractors to process Personal Data in accordance with the Law.

HOW LONG WILL BIAH KEEP MY PERSONAL DATA?

BIAH will retain your Personal Data for as long as it is necessary to comply with the purposes of Processing set out in this Privacy Notice, as well as applicable law, contracts, policies and internal procedures of BI, unless you revoke your consent to the Processing in advance.

MODIFICATIONS TO THE PRIVACY NOTICE   

This Privacy Notice may be modified, changed or updated as a result of new legal requirements, our own needs for the products or services we offer, our privacy practices, changes in our business model, or for other reasons.

We undertake to keep you informed about changes that may occur in this Privacy Notice, through this BIAH Site (www.boehringer-ingelheim.com.mx) or directly in your e-mail, when you request it in writing by the following means: through our e-mail, by correspondence, or by personal means at our address mentioned in this Privacy Notice.

Privacy notice for animal health professionals

Boehringer Ingelheim Animal Health Mexico, S.A. de C.V. (“BIAH”), with address at Maíz 49, Barrio Xaltocan, Xochimilco, C.P.16090, Mexico City, Mexico, shall be responsible for the treatment of your Personal Data, in accordance with the provisions of the Federal Law on the Protection of Personal Data in Possession of Individuals and its Regulations (“Law”). Your Personal Data will be processed in accordance with the Law and this Privacy Notice. The terms used with initial capital within this Privacy Notice will have the meaning ascribed to them in the Law. 

The Personal Data processed by BIAH may include the following: 

  • Full name, gender, marital status, date of birth, address, email, landline and cell phone, social networks and autograph signature.
  • Affiliation to animal health societies.
  • Your official identification details (passport, INE).
  • Data included in your immigration documents such as visas and passports.
  • Academic accreditations, specialty(s) and sub-specialty(s), professional degree(s) and Curriculum Vitae.
  • Tax data, such as RFCs.
  • CURP
  • Data from your bank accounts for payment purposes, on the understanding that BIAH will not have access to your financial data, such as balances or movements in those accounts.

BIAH may collect your Personal Data by any legitimate means.

Purposes of the Treatment: (i) comply with the provisions established in the General Health Law and its regulations; (ii) develop statistical studies, market studies, programs, reports and projects inherent to the activities of BIAH; (iii) conclude contracts for the provision of services related to the activities of BIAH and carry out the corresponding payment for such services; (iv) comply with national and international standards of pharmacovigilance and product complaints; (v) schedule the visit of BIAH representatives; (vi) deliver medical sample, educational, scientific and promotional material in strict compliance with current legislation; (vii) send you invitations to scientific and/or promotional events and carry out the registration of your assistance, in strict compliance with current legislation; (viii) inviting you to participate in research projects, clinical studies, round tables, symposiums and expert group meetings; and (ix) sending information regarding BIAH programs and products by various means, including, without limitation, all existing digital platforms and to exist in the future. 

BIAH may contact you through any means, including, without limitation, personal visits, telephone calls, e-mails, virtual links via any communication device, digital platforms, websites, video calls, text and multimedia messages, postal services, social networks and print media.

BIAH has a policy not to process sensitive personal data if this is not essential for its activities. Please do not provide BIAH by any means with your Sensitive Personal Data. 

BIAH, as the Controller of your Personal Data, will at all times observe the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility provided in the Law. BIAH will also comply at all times with the administrative, technical and physical security measures that allow to protect Personal Data against damage, loss, alteration, destruction or unauthorized use, access or treatment of said Personal Data.   

BIAH may share some or all of your Personal Data with companies that are part of its economic group in Mexico or abroad, as well as with external advisers and service providers acting as Data Processors in the name and on behalf of BIAH, where necessary to fulfill the purposes described in this Privacy Notice. BIAH shall ensure that such third parties maintain adequate administrative, technical and physical security measures to safeguard your Personal Data, as well as that such third parties use your Personal Data solely and exclusively for the purposes for which they were contracted and in accordance with this Privacy Notice and the Law. 

You may request BIAH to revoke and limit your consent at any time and to access, rectify, cancel and oppose the Processing of your Personal Data (“ARCO Rights”) by sending an email to datospersonales.mex@boehringer-ingelheim.com. The e-mail must contain the following:

(i) Full name, email or other means of communicating the response to your request.
(ii) Documents proving the identity of the Owner.
(iii) Clear and precise description of the Personal Data in respect of which the ARCO Rights are sought to be exercised.

In the event that any of the Personal Data of the Owner is inaccurate or incomplete, the Owner, in addition to indicating the above, must indicate the modifications to be made and provide the necessary documentation to support its request.

BIAH shall not be obliged to cancel the Personal Data in the case of any of the cases set out in the applicable Law.

By providing your Personal Data to BIAH by any means, you agree and consent to the use thereof as described herein. In the event that you do not agree to this Privacy Notice, please do not provide your Personal Data to BIAH.

Purposes of Processing: (i) Contracting to provide services directly to BIAH; (ii) Making payments arising from the provision of services; (iii) Issuing credentials for access to BIAH facilities; (iii) Access to BIAH working tools; (iv) Generation of metrics, statistics, reports and projects; (v) Generation of internal query database (iii) Monitoring joint projects under development or implementation; (iv) Requiring compliance with contractual obligations.
